So, you're another internet artist looking to stretch your creative muscles and make a political statement. You spent days thinking about it and finally came up with the idea of taking a photograph of the ass of a man with Our God Emperor's face painted on it squeezing out a log and a woman with an American Flag painted on her face eating that warm ass sausage as it comes out and posting it on Twatter along with the hashtag Fuck Trump.
Now you're sitting in jail and a big hairy gorilla is sniffing your hair and commenting on how he'll keep you warm at night.
What you need to know, besides how to make a reverse chastity belt from toilet paper, toothpaste and pencil shavings to protect your delicate O Ring is that your photograph will face a three pronged test developed to decide if it's obscene and therfor, not protected by the First Amendment called The Miller Test.

The Three Pronged Test

• Whether a reasonable person, applying contemporary community standards, would find, that the work taken as a whole, appeals to the prurient, having or encouraging an excessive interest in sexual matters., interests.

• Whether the work depicts or describes in a patently offensive way sexual conduct as defined by state law;

• Whether the work, taken as a whole, lacks literary, artistic, political or scientific value.

Child Porn

As you may have guessed, child porn faces a much stricter interpretation, having only a two pronged test with a much lower threshold than the Miller Test.

• Depicts an image that is, or appears to be a minor engaged in graphic bestiality, sadistic or masochistic abuse, or sexual intercourse.

• If the image lacks serious literary, artistic, political, or scientific value.

While we are on the subject of Child Porn, it should be stated that no matter what the Pedophile Apologists say, no matter how innocuous a picture of a child may seem, for instance a picture of an 8 year old's feet in toed socks, if it was created or is used for sexual arrousal or gratification, IT IS CHILD PORN. So if you want to keep that picture of your 6 year old niece on a swing, wearing a short skirt with her legs open and showing the world her panties, Don't let people know you play with your dick to it you Sick Fuck.
These so called innocuous pics are what a Lawyer friend of mine likes to call Legalized Child Porn because if you're Sears and putting a 10 year old in your catalogue wearing 2 sizes to small underwear for the purpose of advertising it's perfectly legal. The second a person uses that same ad to get a nut, it instantly becomes Child Porn.

The Tanner Scale

The Tanner Scale was an old time way to judge a child's age based on physical development. Unfortunately it is fraught with problems such as, an underaged child like Traci Lords can appear more mature than some one of a similiar age due to early development and someone, such as a gymnast or an unhealthy person from a Third World Country can look younger because of delayed puberty.
It has been replaced with interpretation meaning, If a reasonable person believes that the subject is underage, then they are.
Before you run to Tijuana to buy those early Traci Lords pornos know that if the age of the girl is discovered and she is underage, it is illegal to purchase, sell or distribute anything with them when they were underage. So expect an IRL Banhammer when you try to cross the border with them.

Currently, on twatter some of Doopie DoOver's soft headed fans like  Lilith Lovett and  Deeve have taken it upon themselves to educate Twatter about something they know nothing about and claim that Child Porn is an inherant right of a person so long as it's called Fanart.
In other words, they say that if you are a fan of Sakura Kinomoto then you are allowed to make images of this 12 year old girl getting brutally gang raped by a large army of horny fan boys for no othet reason than, "Just because".
 Lilith Lovett makes the vapid argument that CP is Child Rape and requires a real child for it to be CP despite Section 1466A of Title 18, United State Code saying "It is illegal for any person to knowingly produce, distribute, receive, or possess with intent to transfer or distribute visual representations, such as drawings, cartoons, or paintings that appear to depict minors engaged in sexually explicit conduct." Like many Pedophile Apologists,  Lilith Lovett argues that CP serves a societal purpose in giving Pedophiles a sexual outlet despite being told time and time again that any image done with the sole intent of sexual arrousal is considered obscene, not because she really believes this but because like so many patreon artists she makes a living doing CP requests from sick fucks at $50 a page and wants to pritect her meal ticket. Like so many High School dropout self proclaimed artists, the law doesn't mean shit to her because she wasn't involved in writing it and everything should be about feelings or what makes you feel good, at least until  Lilith Lovett gets herself raped and then like all uneducated Liberal mouth pieces she'll be screaming for the death penalty.
The irony about our little internet SJW  Lilith Lovett is that for all her claims of respecting the first ammendment and freedom of speech, the second someone says something she doesn't want to hear, she quickly blocks them and plays the GOTIS syndrome of pretending to suffer from intense indignation and demanding her White Knights do something.
So be careful. If your ego is so fragile that you can't handle her first grade punishment of showing everyone that love letter you wrote her for the purpose of punishment through embarrassment, I advise you stay away from both  Lilith Lovett and  Deeve because they are two idiots that think that by putting their Fetal Alcohol Syndrome brains together they'll achieve a DBZ style fusion and become smarter than Both Carl Sagan and Albert Einstein and because of this, they both are fond of using the exact same tactics.
Even worse, if you think you are going to go on Twatter, Facebook or tumblr and argue these mental midgits about what constitutes CP be prepared that they use the liberal tactic of renaming and changing definitions. You won't argue CP but Fanart. There is no such thing as obscenity, just closed minded people that aren't as progressive as them. Most importantly, they define what the first amendment protects. Instead of wasting your time with these mental midgets, let me just suggest the far more satisfying option of going up to a brick wall and punching it because you'll get the same exact reaction from the wall without  Lilith Lovett sending her flying monkeys after you who'll spam up your email or twitter feed.
